Terms & Conditions for Gut-Brain Nutritionist

Welcome to Gut-Brain Nutritionist.  This website is owned and operated by Livia Zoller, Sole Trader. By visiting our website and accessing the information and services we provide either through this website or in person through one-on-one consultations, you understand and agree to accept and adhere to the Terms & Conditions as stated in this policy (will be also referred to as "User Agreement").

Our Terms & Conditions relate solely to our services provided via the Gut-Brain Nutritionist website, and together with our privacy policy govern Livia Zoller, Sole Trader's professional relationship with you. If you disagree with any part of these Terms & Conditions, please do not use our website or request our services. 

This agreement is valid from 10 May 2018.

We reserve the right to change this User Agreement from time to time without notice. You acknowledge and agree that it is your responsibility to review this User Agreement periodically to familiarise yourself with any updates or modifications. Your continued use of this site after such modifications will constitute acknowledgement and agreement of the modified terms and conditions.

These Terms and Conditions below outline the terms and conditions for the Services provided by the Gut-Brain Nutritionist (GBN) - Livia Zoller to YOU - The Client.

(Please also read the Privacy Policy for additional terms relating to the interaction between YOU and the GBN.)

1 Explanation Of Basic Definitions 

a) Services – means Naturopathic Nutritional Therapy Services as more particularly described in Clause 3

b) Gut-Brain Nutritionist (GBN) – means Livia Zoller Sole Trader and qualified Naturopathic Nutritional Therapist

c) You – means The Client, an individual ordering the Service

d) Charges - means the charges of the Gut-Brain Nutritionist which are payable by You for the provision of the Service as initially advised to You prior to You placing Your order for the Service.

2 Charges

2.1 Payment of the Charges is required in full prior to the consultation. The GBN shall be under no obligation to provide the full Service to You unless and until You have paid the Charges in full.

2.2 The same charges will apply for consultations in person, via Skype or phone.

2.3 Payments can be made by cash, bank transfer, or Paypal.

2.3 Service Charges include:

a) Initial Appointment (Foundational Programme) - £160

  • Includes a 1 h 45 minutes Initial One-to-One consultation in person or via Skype/phone and a 6-8-week starter programme emailed to you.

b) Follow Up Appointment (Advanced Programme) - £120

  • Includes a 45 minutes One-to-One consultation in person or via Skype/phone and 6-8-week follow up programme emailed to you.

2.4 Additional Charges at £15 per 15 minutes might be applicable for the following:

  1. Changes in the emailed programme

  1. Detailed email response to a specific question

  1. Additional requests by you

d) Phone consultation

You will be notified by GBN if there would be additional charges due for your request and you will have the option to go ahead or wait with your requests or questions until the next Follow Up appointment.

2.5 The GBN reserves the right to change the above Service Charges any time. The price change won’t affect past payments. You will be notified of the changed service charge prior to making new payment.

2.6 You may incur further charges for functional/private lab tests and supplements. These charges are payable to the companies providing the service/products.

3 Provision Of The Service

3.1 The GBN Service currently is only available to individuals aged over 18 years of age.

3.2 The Intake Form is required to be returned by email, an absolute minimum of 3 working days before the consultation. You will be requested to fill out personal, contact and medical details. All details will be kept confidential and protected in accordance with the GDPR.

3.2 The Service consists of the provision to You of individual dietary, supplementation and lifestyle related advice with a written programme report emailed within 7-10 days of the consultation. The consultation can be conducted in person, via Skype (or other online communication) or phone.

3.3 The GBN requests You (The Client) to note the following:-

  1. The degree of benefit obtainable from Naturopathic Nutritional Therapy may vary between clients with similar health problems and following a similar Nutritional Therapy programme. Nutritional advice will be tailored to support health conditions and/or health concerns identified and agreed between both parties.

  1. Naturopathic Nutritional Therapists are not permitted to diagnose, or claim to treat, medical conditions.

  1. Naturopathic Nutritional advice is not a substitute for professional medical advice and/or treatment.

  1. The GBN may recommend food supplements and/or functional testing as part of your Nutritional Therapy programme and may receive a commission on these products or services.

  1. This document only covers the practice of Naturopathic Nutritional Therapy within this consultation, and the GBN will make it clear if she intends to step outside this boundary.

3.4 YOU, The Client understand and agree to the following:

  1. You are responsible for contacting your GP about any health concerns.

  1. If You are receiving treatment from your GP, or any other medical provider, You are responsible to tell him/her about any naturopathic or nutritional strategy provided by The GBN. This is necessary because of any possible reaction between medication and the naturopathic programme.

  1. It is also essential that You tell the GBN about any medical diagnosis, medication, herbal medicine, or food supplements, You are taking as this may affect the naturopathic and nutritional programme.

  1. If You are not clear about the GBN recommended nutritional therapy programme/supplement doses/time period, You must contact the GBN promptly for clarification.

  1. You must contact the GBN should You wish to continue any specified supplement programme for longer than the original agreed period, to avoid any potential adverse reactions.

  1. Recording consultations using any form of electronic media is not allowed without the written permission by both the GBN (Livia Zoller) and You (The Client).

3.5 Email support is provided on a weekly basis (once a week) from the receipt of your written programme report up until 8-weeks.

3.6 Additional changes or requests to the emailed report and any additional phone consultations are charged as per Section 2.4.

3.7 The Service does not include (and the GBN shall be under no obligation to provide to You) any services which it would be unlawful, illegal or unethical to provide or which would require the GBN to act in breach of any code of conduct or other regulation to which she is subject to.

4 Cancellation Policy

4.1 The GBN operates a minimum of 72 hour cancellation policy (excluding weekends). If you are not able to attend your confirmed appointment, you are required to notify the GBN within this time period.

4.2 If you fail to notify the GBN of your intention of cancellation within 72 hours, the following fee may be applicable:

  1. £30 for Initial Appointments

  2. £15 for Follow Up Appointments

5 Refunds

5.1 You are entitled to full refund of your payment if you cancel your appointment within 72 hours of the time your appointment is due.

5.2 You are entitled to refund half of the charges if you attend the consultation but you decide you don’t want to go ahead with the programme and receive the written report.

5.3 You are not entitled to any refund once you attended the consultation and your written programme report has been emailed to you.

6 Service Standards

6.1 The GBN shall provide the Service to You using reasonable skill and care and in accordance with all legal and regulatory obligations which apply to Naturopathic Nutritional Therapists and provided services.

6.2 Standards of professional practice are governed by Code of Conduct of the CMA (Complementary Medical Association).

7 Governing Law

7.1 These Terms and Conditions, the provision of the Service and the relationship between You and the GBN generally is governed by the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to hear any dispute.
